Thanks And Gratitude For This Time Of Year

Thanks And Gratitude For This time Of Year! It’s time for thankful reflections of gratitude. We are thankful for the continued ultra low interest rates that are enabling many to buy a home. We are thankful for Confident Buyers and Realistic Sellers. Real estate Agents that are helping Buyers and Sellers gain perspective to navigate these challenging times and not whining as they help them accomplish their goals.

We are thankful for the opportunity that young families can achieve and enjoy the American Dream of home ownership due to today’s low prices. For the amazing loan programs available that allow for a magical buying experience. The fine standards of practice in the Northern Nevada real estate industry including escrow officers, lenders, inspectors, as well as Agents. Together we have a wonderful service oriented community of true professionals that help and protect the public as they should. We are grateful to have such quality professional peers to work with.

We are thankful for the scenic beauty and wonderful people of our communities. The life enhancing opportunities available for our children such as Pop Warner football and cheer leading and the many other superb youth organizations filled with great civic-minded volunteers. We are thankful that the Youth are still and always important in our communities, and that Values are respected and a way of life for most. We are thankful for our many Seniors that stay active in the community and impart their experience and wisdom so we don’t lose our way.

The plentiful water we had this year is cause for thanks. The Valley was green well into Fall, and the crops abundant. We are thankful for the many community events where we play and celebrate together. That we can enjoy free concerts and movies in the park, parades, Wine Walks, and more communal activities where we visit with friends and make new ones. That people still stop to help one another. People still say hello to strangers with a smile. Drivers are courteous – let you in rather than cut you off. The right to vote and the many freedoms we enjoy in this great country of ours.

Our Advice: We are especially thankful for the incredible strength and support of our amazing community as we suffered the passing of a loved one this year. We are eternally grateful for the love we needed and received during this incredibly trying time.

Be thankful for your health, your family and your community. Be thankful for the strength and understanding to carry on when you have a hiccup in the well-being of one of the above. Be thankful for the ability to learn the lessons coming to you during such times, and the good that will result. Every cloud has a silver lining … every cloud.

Be an example of gratitude and be thankful for what is … not resentful for what isn’t. The real estate market is what it is today, not what it was yesterday, or what it will be tomorrow. Be thankful you can establish your priorities and keep the reality of real estate challenges you might be encountering in perspective – its only money and, thankfully, you can get that back. You can’t get back health and the time with your family so keep both strong and plentiful and be thankful that you can.

Maintain a grateful awareness year ‘round and you’ll find much sweetness in your life. These are the good old days!

Think Of Selling When Buying A Home

You’ve negotiated a great price on a home and you’re ready to buy … Stop and Think Of Selling When Buying A Home. It has everything you want right now in a home, but is it a good investment? To be a good investment, it should not only serve your wants and needs well while you live in it, but it should also be something that makes financial sense when you sell. As you find and buy a home you should always think about how you are going to get out of it. Will it be relatively easy to sell when you are ready to sell it?

Regardless of your intended holding period, it is very important to analyze the saleability of your home before you buy it. Many folks retiring to our area figure they are buying their last home. When the subject of resale comes up they laugh it off as unnecessary. Things ... we call it "Life" ... happen, however, and resale must always be considered regardless of current intentions. Even if you aren’t subject to moving because of employment circumstances any more, there are many other factors that can come in to play, i.e.- health, family, personal interests, etc. that can necessitate an unexpected move.

Buyers today have many buying opportunities, and must be selective. Some ultra low price opportunities are not really the best long term purchase. If a property has location, floor plan, or floodplain problems today, it will still have the same problems when it's time to sell it. The attractive low price relative to the market today will be as low, or lower, when the market gets more competitive. The converse is true. A quality home will always be preferred over inferior properties, and has a better chance for
appreciation, and will sell quicker.

When predicting future saleability there are many things to consider. Look at the street. Does everybody take care of their property? Is it a neighborhood in transition? Up or down? Are there any physical characteristics of the neighborhood to be concerned about including busy roadways, noise or odor from neighboring business operations, etc.? Are new subdivisions being planned in the community that will compete for future Buyers? Are you going to correct existing deficiencies or make other changes that will affect value during your ownership? If you buy a home with a one car garage, one bathroom, or other similar sale-stifling characteristics you must plan to fix them or your resale will be adversely affected.

Our Advice … Stop and Think Of Selling When Buying A Home!

Always think of selling when you buy a home. If you are getting the deal of the decade on a home there might be a reason. Is it the biggest on the block? Is it functionally or otherwise obsolete? Is something changing in the neighborhood that will decrease, or increase demand, thus value? When selecting a home, make sure you know what’s going on in the neighborhood, how that home compares to the neighborhood, and how the neighborhood fits in to the community overall. With that perspective you can proceed comfortably with confidence. Your agent should help you with this very important assessment as you prepare your offer. It can have a direct impact on the price you offer – up or down.

As you enjoy the euphoria of finding a great home, be sure your agent looks in her crystal ball. In a perfect world you will live in your home in accordance with your intentions, but if something changes it is good to be prepared.

Beware! ... Some The Oldest Tricks In The Real Estate Book

Every profession has its tricks. We’re not talking about tricks to make things smoother, rather the tricks that prey on the unsuspecting public. The Real Estate Profession is no different, in fact is renown for having a plethora of unscrupulous people taking advantage of the good name made by the hardworking honest Professional Real Estate Agents. The amazing thing about tricky people is that they seem to use the same old tricks and the public continues to fall for it. Here are some of “The Oldest Tricks In The Real Estate Book”.

“If you list with me I have a Buyer for your home.” Does that Agent not have a Buyer if they don’t list with her? What does that tell you about the Agent? If she truly had a Buyer that she thought the home was perfect for wouldn’t she show it to the Buyer because it is the right home for them? By not showing them the home for her own personal reasons is she really working for that Buyer? The reality is that 99.9% of the time there is no Buyer, just an empty promise.

Occasionally an Agent will say he can sell your home for much more than anybody else says they can, another old trick. This sounds great of course, more money. The problem is that market is what market is. Though some Agents get consistently higher prices for properties than others due to skill we aren’t talking about that here. We are addressing the situation where one Agent will list the property $50,000 more than everybody else said it was worth.

What follows one of three things:

1. He works you over week after week to get a price reduction until you eventually get to the price point where it will sell… having lost a lot of time and even money if you end up following the market down during the lost time.

2. The property doesn’t sell and you have to start over with a new agent only your property is now shop-worn.

3. The property sells, but won’t appraise for the new Buyer. You end up capitulating on the price and you’ll never know if the Agent that listed too high spoke behind your back to manufacture the sale situation.

Buyers can get duped by only being shown select homes. The trick here is to show a high priced listing to compare the home he is going to sell them to… often the Agent’s own listing. This is harder to do these days with the amount of information on the Internet, but it is still something to be aware of. If truly working for the Buyer the Agent will present everything that meets the Buyer’s criteria regardless of who the Listing Agent or Seller is.

Our Advice: The oldest tricks are still used because they work. There are many consumer protection laws but it is hard to prove that you were duped by a tricky unscrupulous Agent so it is best to be aware. The facts are what they are – no glossy talk will change reality. Don’t let the strength of your desires cloud your reasoning. You should have enough information to make an informed decision, not an emotional reaction. Don’t believe someone can accomplish something that the industry can’t – they can’t either. This doesn’t include specialty properties or insight, but that must be specifically explained. A professional Agent will help you understand what and why they said something so you get a true perspective and understanding of the market and how you fit in. Tricky Agents are few, the vast majority of Agents being very professional.

Professional Agents work hard for you to accomplish your goals without chicanery, or tricks.

Changes In Nevada Seller’s Real Property Disclosure

Changes In Nevada Seller’s Real Property Disclosure

New disclosure regulations and a new version of the Seller’s Real Property Disclosure form (SRPD) became effective in Nevada on October 1st. The SRPD form used in most residential real estate transactions has several noteworthy changes. The first is on page one of the four page form where the option of a Seller declaring exemption per terms of NRS113.130(2) has been removed. In its place are options to declare the type of Seller, i.e.- Bank (Financial Institution), Asset Management Company, Owner-Occupier, or Other and a blank to fill in.

Also added on page one is the following statement, “Systems and appliances addressed on this form by the seller are not part of the contractual agreement as to the inclusion of any system or appliance as part of the binding agreement.” Yes, it sounds confusing to us as well. If an item like a hot tub isn’t included it would seem logical to mark the N/A option, Not Applicable. If you are including the item then it is part of the agreement regardless of what this
new clause is trying to say.

Another new disclosure clause is pretty self-explanatory, “Has property been the site of a crime involving the previous manufacture of Methamphetamine where the substances have not been removed from or re-mediated on the Property by a certified entity or has not been deemed safe for habitation by the Board of Health?” This information can be vital to a Buyer’s decision making process, from price offered to rescission options.

The last SRPD detail change is the addition of a question asking if the property is subject to a Private Transfer Fee Obligation. A Private Transfer Fee Obligation is as an obligation created by a declaration, covenant, or any contractual agreement or promise, whether or not recorded, that requires the payment of a private transfer fee to the declarant, or other specified person, or to his or her successors or assigns, upon a subsequent transfer of an interest in the real property. The most recent Nevada Legislature deemed that Transfer Fee obligations violate the State of Nevada public policy by impairing the marketability and transferability of real property and by constituting an unreasonable restraint on the alienation of real property. Good to know if you have one.

Two important legal changes appear in the law portion of the SRPD. The first says that a purchaser of residential property may not waive their disclosure rights and a seller may not require a purchaser to waive any of their rights. This had become a prevalent practice with so bank owned properties and is no longer allowed.

The second change addresses property sold by foreclosure. Now, in addition to existing disclosure requirements for any defects known to the Trustee and beneficiary of the deed of trust, they must now provide the contact information of any asset management company who provided asset management services for defect repair or replacement whether or not the efforts were done to completion.

Our Advice: Sellers - always, always, always…“when in doubt disclose”. Buyers, be sure to read the SRPD. There are legal rights available to you if the Seller doesn’t provide a disclosure, or is fraudulent with what they do or don’t disclose. Penalties can be up to three times damages you incur. Don’t simply rely on a Seller’s disclosure efforts.

Buyers and Sellers have a responsibility to disclose and investigate the property that is the subject of their transaction. Do your part.

If the Listing Agent is 450 Miles Away … Run … Do Not Walk … To the Next Listing!

It closed!

Thanks to the Real Estate gods and a very patient buyer … our, “Must Close in 30 Days” Bank Owned Home in Carson City, Nevada finally crawled to a screeching close 89 days after our offer was accepted.

Nothing from the initial showing to the final close was user friendly in this transaction!
No Code! Can’t get into the house because no one at the “Service Number” knows the procedure and the Listing agent doesn’t belong to our MLS so he doesn’t need to comply with our Lock Box standards. How hard is it anyway to put the code into MLS? We made three trips to see the house before we got in!
Next … the pleasure of presenting the offer on a special website that doesn’t function and won’t update.
Goody … A listing agent, 450 miles away, who has no idea what is going on because everything is handled through a “Servicer” 3,000 miles to the east of both of us.
Every phone call to the listing agent is answered by an obnoxious voice mail that gives me 49 steps to solve every problem except the one that I’m actually calling about.
A "Never Ending" three week procedure to turn on the utilities so that we can get the inspections that we only had 7 days to complete in the first place.
Extension #1 … Need to extend the closing due to the giant "Pad Lock" on the Garage door to “Secure” the property. No one remotely connected to the “Lock” has a clue to the location of the key. My solution … I cut it off! Three week extension done!
Extension #2 … Seller fails to send the Power of Attorney to the Title Company so that the new lender will approve the loan! Two weeks of intense email and phone communication to get this accomplished. The “Servicer” actually called me one morning to inquire … “Why is the Buyer not ready to close?
DUH!!! The Buyer is NOT the problem!
Loan Approved! Yeah! Almost!
Buyer’s lock is ticking. They are anticipating a wonderful “move in” experience ... finally! Docs are signed, funding is poised … All we need is the Seller’s Escrow instructions and deed!
Drum roll please! … We Wait … and We Wait … and We Wait!
Extension #3 to our 30 Day Close! No Docs! … No Close!
Two days after the second 10 extension expired we got a email from the Servicer that the “Closing Documents” had been sent and that we should expect them the following Monday. (Kind of a "Fib") ... to put it nicely ... they were never sent!
Surprise … not really … On Thursday of the following week ( three days after our extension EXPIRED) we finally got a tracking number for Fed Ex that showed the closing docs were picked up THURSDAY Morning for Friday delivery (not to mention 3 days past our expired extension)! Ok, as Long as they get here we can live with that!
Friday … full of anticipation after 89 days of trying to buy a house with a 30 day close … the Fed Ex Arrives … the deed arrives … the escrow instructions … DO NOT ARRIVE!
OMG!
Another flurry of frantic emails and phone calls! How the heck can we close without the escrow instruction? Well … due to the herculean efforts of a fantastic Escrow Officer, Rischell Thompson of First American Title … we got them via email, we closed, and the Buyers got their house!

My final email of the day from the listing agent … “The Signed Extension for Closing This Home Next Week Attached."

Give me a break! We deserve battle pay! Our business has gone beyond reality to insane.

The Zeal Of The Deal in Real Estate (edit/delete)

"The Zeal Of The Deal in Real Estate"

Buying or selling can be exhilarating, we call it “The Zeal Of The Deal in Real Estate”.

Certainly, most residential transactions contain emotion in copious quantities. It is important that "The Zeal Of The Deal in Real Estate" not impact the participants in a negative manner. Who are the participants? ... The Buyers, Sellers and Agents. If emotion clouds reason bad things can happen.

The agent should always protect the customer/client regardless of how fast or slow things are moving. The Agent shouldn’t get emotionally involved in the transaction and is there to guide everyone to a smooth “landing”, close of escrow. Unfortunately, sometimes they get excited about selling something and caution is thrown to the wind.

True story we saw happen recently … Sellers and Agents ... hoping against hope ... for eight months that an escrow will close even though the “Buyer” never even put up an Earnest Money Deposit, no less prove ability to fund. Everyone involved in the transaction was so afraid to press the “Buyer” to perform in their zeal for the million dollar deal. The "Buyer”, and we use the term loosely, refused to perform the minimum contractual requirement! Handwriting on the wall … It all ended up being all for naught. Of course … It didn’t close.

Sometimes the “Zeal” in a deal is to Kill It! This can result in a party wanting out so bad that mistakes are made during the rescission process. Whether the Agent or Buyer is the driving force, pressure to effect the cancellation can result in the unnecessary forfeiture of the Earnest Money Deposit. Take the time to explore the options and minimize risk before you take action. Understand the consequences of your action. Sometimes just the language you use will be the difference between keeping or losing thousands of dollars. Pay attention!

It isn’t always speed that causes mistakes in judgment or practice. We once had a building over 100,000 square feet with a sales price over $3 million close in five days. Things can happen quickly, and often that is the best way to get a great price, but they must happen correctly. Don’t “assume” … you know the definition of that … things will work out right. If there is work to be done after the close of escrow make sure there is someone responsible for performance and that there are consequences for non-performance. Often in the excitement to close, things are promised and/or overlooked, but when things calm down after the close their relative importance can be different for the promise maker and the the new home buyer who is counting on that promise!

Our Advice: Zeal can be good – things get done, but don’t get overzealous to the point of compromising your wants, needs or integrity. All the paperwork must be in order, signed correctly, and in a timely manner. Keep your cool and work through the process. Every transaction has a “punch list” that should be completed for that type of transaction, i.e.- inspections, estimates, survey, etc. If you miss a step understand why you are doing so, what the consequences are, and make an informed decision on moving forward, pausing, or otherwise. Each situation is unique and its circumstances will dictate the course of action required for you to achieve your objective. No matter how bad you want to close a sale, it must be right for you and yours, very little can justify compromising or risking your peace and prosperity. Stay focused and make sure the right thing happens when it should and your zeal will be justly rewarded.

Be enthusiastic, but don’t let anybody’s “Zeal For Their Deal” blind you. You may be paying an exorbitant price for a long time if you do. The price can be financial, emotional or legal, but not what you bargained for.

Fifth Annual Sierra Lutheran Falcons Fundraiser at the Minden Food Company (edit/delete)

Fifth Annual Sierra Lutheran Falcons Fundraiser at the Minden Food Company.

The Minden Food Company again hosted the annual wine tasting fundraiser for the Sierra Lutheran Falcons basketball team. Held in the middle of the street outside the Minden Food Company restaurant, the event has become a highly anticipated time to see old friends and catch up. Each special event in our small town draws its own crowd and this one is always special, the old guard.

In addition to the Minden Food Company prepared taste treats served by roaming “waiters”, basketball players, there is live music, authors signing their books, art for sale, and other appropriate vendors. The time of year is perfect for an outdoor event, not too hot or cold.

The event is symbolic of the coming together of the many passions of Alan Reed. Alan is the coach of the Sierra Lutheran Falcons basketball team, having been a standout at Douglas High and played college ball. He is the owner of The Minden Food Company, and he likes an occasional class of good Cabernet Sauvignon. This event is the culmination of all three passions. Alan is everywhere visiting at the event, making sure that everyone is having a good time.

It is another one of those fine Carson Valley events that gets many out of their routine to participate in and experience a nice evening. What a fun way to support the youth of our community. Tickets are limited so be sure to get yours early next year wen they become available for the Sixth Falcons Fundraiser.

Doing The "Walmart Wait" in Carson Valley, Nevada.

Walmart is coming to our small town. We have a big one and a nearby Costco at the north end of the Valley, about 15 miles north of Gardnerville, and one in Carson City, about 8 miles north of that, but they are building another down our way.

Rumors abound about a construction start date, but so far all that has been done is offsite and some onsite improvements. Every 6 weeks, or so, there is an article in the paper giving a status update on the permit draw and estimated start date.

So how are the local merchants preparing? The oldest grocery store in Carson Valley, Raley’s, has done an extensive remodel, both interior and exterior. New façade, new floor, ceiling, display cases and lighting. There are even three different types of check out available now. You can check yourself out, get in a line and unload your own basket, or get in another and have the checker unload the basket for you.

There’s a new hardware store in town that has taken the expansion route. They have expanded their showroom several times over the past few months and added substantial inventory. Their inventory is such that they will have good separation from what is typically offered at a Walmart store.

The cost savings is substantial on many items when shopping at a Walmart. It used to take a contemplated decision to determine if it was worth a trip to the store. Would the travel expense be justified by the savings. Now, however, Walmart is bringing the savings to the Carson Valley residents. They will be in our backyard staffed by neighbors and friends. Hard to say, "no".

Each time we’ve had a new store come in to our tiny community the old stores have made adjustments to compete, including reducing their pricing. It is disappointing to see that they can not only survive, but thrive with the reduced pricing. What were they doing to us all those years? Competition is good, capitalism at its finest.

We will support the businesses that support us, our youth sports, and our community. Thus the hardware store will be unnamed as they were reluctant to help a local youth sports program.

Too bad ... a small town is like a large family!

Lost Our Mobile Mouse Traps ... "Mouser" To The Rescue!

We lost two of our mobile mouse traps this year and have been surprised at the consequences. Our two best mousers, Chester and Stash, so named because he had a bright orange mustache, both passed at ages 19 and 17. After missing the kitty offerings at the backdoor … vole and mouse remnants … we started finding other “gifts” in the form of little black pellets.

The combination of changed weather, and lack of outdoor cats created an amazingly fertile rodent situation. The alfalfa fields had voles like never before, and mouse sightings in the garage were soon common place. We missed our old cats and their contribution to the household!

The rodent population reached a point where action was necessary. A dozen traps and high body count later we are getting a handle on the garage situation just ahead of the winter months when many rodents try to move inside.

We also took the best step – we got a new mouser. His name is “Mouser”, and he’s a definite keeper. He has big paws to grow in to, and a great disposition. He is currently assimilating in to the household, getting to know the dogs and other cats. He is holding his own, eating with the dogs and getting his own sleeping spot on the bed.

He is very curious about the garage, even made a couple of breaks into it over the past week. Mouser is destined to a great existence – the best of both worlds. He’ll have all the time in the garage and fields that he wants to hunt, and will undoubtedly spend his sleeping hours on a soft pillow somewhere in the house. Chester used to sleep everywhere – in the chicken coop with the chickens, on top or underneath things – was flexible, curious, and interactive with his world.

Mouser seems to have much of the same personality and came to us the same way … a rescue. He could be a 20 year cat – we hope so the more we get to know him.

The Weeds Keep Growing in Carson Valley, Nevada.

The weeds keep growing in Carson Valley, Nevada. Its been an amazing year for weeds in Northern Nevada. Last year’s wonderfully wet winter fueled an abundance of weeds that continue to grow and grow. We’ve had much more precipitation than normal all through the summer months as well creating growing opportunities for the weeds like they rarely see in this area.

It is a common topic of conversation among Carson Valley Ranchers, Gardeners, and Homeowners, weather and weeds. The foxtails were unlike any year anybody can remember – growing everywhere in copious quantities. It drove the hay growers nuts. Dog owners were grooming and grooming and even at that ... there were plenty of occasions where the vet was the answer to the persistent prickly pugnacious foxtail seed.

As we near fall the weeds are tall, but soon we’ll be able to burn them as well as cut and spray. Sometime in October, when it is deemed safe, the East Fork Fire District will issue burn permits. Home and property owners will be able to safely burn the tall weeds, and the seeds that they bear, to minimize their reproduction next year. It also opens ditches for better flow, and clears the land for crops or more human friendly vegetation to grow.

Just burning them won’t eradicate them, but it will help minimize their spread. Some, such as thistle, take more work. They grow in colonies and have an extensive underground network. That is better accomplished by spraying with the right chemical mixture.

Carson Valley, Nevada is still mostly green, very unusual this time of year. With the warm weather and recent thunder showers there is a good chance it will remain green until the frost. This creates some very extended special times for foraging animals as their feed is plentiful and vibrant much later than normal.

Nothing like a little water in the desert ... it's very fertile … with a touch of the Liquid Gold.

Friday Night come out and watch the Douglas Tigers play football! Douglas Pop Warner Football and Cheerleading plays on Friday nights at Stodick Park in Gardnerville. The first game is Friday, September 9 beginning at 6:00. Three teams will open at home this year, Tiny Mite White, Junior Pee Wee, and the Pee Wees. Come see the future stars of Douglas High as they debut their 2011 season and their new uniforms. The new Tiger look will be unveiled Friday night.

The snackbar offers great treats including Nevada made Sausage Factory hot dogs, chili Fritos, popcorn, hot and cold drinks and more. Tiger spirit gear can be purchased so you can show your Tiger Pride. Gear includes hats, visors, sweatshirts, tee shirts, jewelry, hitch covers, and more. Visit the snackbar to round out your Friday Night Experience.

The Tiny Mites are 5-7 years old, Jr. Pee wee 8-11, and Pee Wees 9-12. A good night to see a variety of levels of play. All three are playing teams from Sparks Nevada this week. Stodick is a wonderful venue with gorgeous mountain views, open fields on two sides, and a nice fall nip in the air when the sun goes down. A good time of year to enjoy the wonderful game of football being played to a high level by dedicated Douglas County athletes.

It takes a lot to round out a community, like the Unsinkable Volunteer Spirit in Northern Nevada!

There are many government services these days that provide and assist in a variety of ways, but it is not financially possible nor is it practical for government to provide the funds or labor needed for a “complete” community. We’re talking about a community with youth sports organizations, elder social opportunities, education and social opportunities, and more.

The Volunteer Spirit in Northern Nevada is a reflection of the quality of the Nevadans who live here! It’s through the continued contribution of many generous individuals that our communities to thrive and serve the population! Consequently … Great Nevada Communities translate ultimately into demand in our Northern Nevada Real Estate Market! Everyone wants to live and work in a vibrant community!

There are many non-profit organizations in our communities with exceptional volunteers that make a difference like 4-H Clubs, City of Refuge, Carson Valley Food Closet, Mothers Against Drunk Driving, Nevada Civil Air Patrol, Northern Nevada Search and Rescue, etc., and the assorted service clubs like Carson Valley Active 20/30, Kiwanas Club of Carson Valley, Minden Rotary, Carson Valley Lions Club and other -Profit organizations run on volunteer labor, contributions, and participation. It is important that they have all three for their survival and quality of their “product”. Each affects the community in a positive and memorable way by their hours of dedication, sponsoring of community events, and contributions
to maintaining the quality of life that we all enjoy.

Some local non-profits are renowned on a National level including the Kids Fishing Derby in Gardnerville and the Candy Dance in Genoa. The Fishing Derby has year round administrative volunteers, but utilizes the volunteer time contribution of 300 people for their two day event. Candy Dance attracts tens of thousands of people with the help of a few hundred.

Other great local volunteer events enjoyed by thousands are Carson City’s Frontier Days, Nevada Day Parade, Carson Valley Days, and the Camel Races in Virginia City.

Without the opportunity to participate in team sports our youth would miss out on learning the many values learned by such involvement. In our communities we have excellent Pop Warner Football and Cheer Leading programs, Carson Valley Little League Baseball, Carson Valley Girls Softball, Carson Valley AYSO soccer, and more. These are only available because of the thousands of volunteer hours that are donated by the many volunteers in each organization. Their efforts allow for experiences that would otherwise not be available.

Our Advice: Non-Profit organizations run on volunteer labor, contributions, and participation. It is important that they have all three for their survival and quality of their “product”. In these times of economic challenges many donations have been reduced. The non-profits are continuing their endeavors with less, as much of society is today. For many their volunteer base has even been diminished as people have less discretionary use of their time. It is essential to give when and where you can for the good of your community and everyone’s future! Do what you can and know when you do that you are helping to make a difference in many Northern Nevada Lives.

Real Estate Agent Speak … What Does It Mean?

Real Estate Agent Speak … What Does It Mean?

Agents say many things in their advertising, but often we’re left wondering what does it mean?

There is always an implied meaning, but the serious Buyer usually wants to know what they are really saying about a property. Sometimes even agents don’t know and need to make a translation phone call to find out.

For example, “Gourmet Kitchen”. A kitchen is often termed Gourmet if it has a 5 burner, or larger, cook top, over sized vent hood, and a double oven, but does that make it gourmet? We’ve had true gourmet cooks comment on the abuse of the term. One of their key determinants is the quality of the fixtures, i.e.- high heat cook top and broiler capabilities. A pot filler spigot by the cook top is fun, but does it a Gourmet Kitchen make?

The "Great Room" is another term used liberally. Is it an Open Floor plan – divided by pony wall but open, or is it one big room with the kitchen and dining areas in it? Mother in law unit is another advertising dandy. Is it a separate building or an add-on? Does it have its own kitchen, living room, private patio or garden?

“RV Parking” can be anything from room on the side of the house to park a tent trailer to a parking area for any sized RV complete with water, dump drain and electricity. “Horse set up” can be a lean-to with panels or a barn with power, tack room and automatic waterer. “Garden area" can be rose or vegetable, functional or token.

“Fully Landscaped” – is it natural sage or lawn, shrubs, and trees? “Needs a Little TLC” – anything goes with this one. A little Tender Loving Care usually means thorough cleaning, yard care and paint, but could turn out to be carpet replacement, and more. It’s a little better than a “Fixer Upper”, but not “Move in Ready”. “Fixer Upper” That can be all the above plus broken windows, punched sheet rock and doors, missing fixtures and roof shingles, etc.

“Carpet Allowance” signals worn out or cat-affected flooring, but not always. A carpet color recognized to be unappealing can induce an allowance to help a sale. “Dog Run” can be anything from a cross fence by the garage that creates a closed area, to a true dog run with proper fencing, concrete for easy cleaning, dog house, etc.

“Great for First Time Home Buyer” usually means it is nominally priced or modest, but can also simply be smaller.

“Great Family Home” is another just about anything goes comment. Does it mean that there are many bedrooms, or enough bathrooms to get everyone out the door in the morning? Does a family or bonus room offering separation of kids from adults make it family? What is great for a family will truly be family specific.

Our Advice: Descriptive terms and what they represent mean a lot to a Buyer and can be an important factor in a sale. It is important to represent the property and its attributes accurately. Have your agent make sure that what has attracted you to the property works for your wants and needs, and isn’t something that has the description of what you want but is only 25% of your expectations. Description abuses can be laughable at times, but they can also waste time. Be sure to determine what that “cream puff” is really all about.

Ad language is designed to attract, to make the phone ring. It’s up to the Buyer and her Agent to determine if the property description is puffed.

Private Property rights are essential to real estate. Included in the bundle of rights is the right to quiet enjoyment. Regardless of the size of the property, everyone enjoys this right. We’ve seen occasion, however, where larger parcels of land are mistreated by the public Sometimes its trespassing, other times it is more flagrant.

The other day as we were leaving our house we saw a person stop by the road. We thought nothing of it until we saw in our rear view mirror that she was pulling a cage out of her car. We pulled over and walked back. Her intention was to release a skunk by the irrigation ditch in our front field.

Yes, we live on 10 acres and, yes, it is rural ... people live nearby and so do our chickens and ducks. We explained how the skunk will walk down the ditch to our home in the distance and feast on our birds all winter.

We invoked God’s blessings on her for saving the baby’s life, and her well intended mercy act was taken to another venue saving 15 or so feathered lives, that's how many birds we lost last year to skunks and other predators.

As a Property Owner, your front yard is no different than your kitchen when it comes to your Private Property Rights. It is yours and nobody should use it without your permission whether as a trash receptacle, bedroom to camp in, or just to cut across the corner. Whether you own a condo, 10 acres, or thousands, the Private Property Rights are the same and nobody should have them compromised because of the size of their front yard.

The Nevada Homestead Exemption Act

The Nevada Homestead Exemption

The Nevada Homestead Exemption Act doesn’t mean you can squat on 160 acres of public land and eventually own it, rather it is a means to protect equity in your home against seizure or forced sale by general creditor claims and judgments that are entered against you. The Nevada Homestead Act is one of the gifts the Constitution of the State of Nevada gives to homeowners, but few people take advantage of it.

If you have unpaid medical bills, credit card debt, business or personal loans, a judgment from an accident or other cause, etc., you can protect the equity in your primary residential property up to $550,000 in Nevada. The key word is equity, the market value less any debt secured against it. The property must be your primary residence. It can be a condo or even a mobile home on land you don’t own. Exception - if you are one of the rare few that has established alloidal title and not relinquished it the exemption extends to all of your equity.

A Homestead Exemption does not protect you from a forced sale due to nonpayment of a mortgage, unpaid taxes, home equity loans, Home Owners Association/Condo fees, or work that was done on your home. Also, be aware that Federal Bankruptcy Court can modify the protection of the Nevada homestead exemption for some credit card debt.

The homestead exemption application can be made by husband or wife, or both, or a single person. A recent change by the Legislature allows protection for individuals that put their property in a trust provided the trust if for the benefit of the person or persons who declared the homestead. Another interesting quirk is that Tenants in Common may declare homestead rights on their respective estate and enjoy homestead rights and privileges. Note that they are, however, subject to the rights of their co-tenants to enforce partition of such common property.

The Homestead Exemption is easy to implement and free except for the cost of recording the document. You can get the form online at the Nevada Real Estate Division site, http://red.state.nv.us/forms/654.pdf, or at your County Recorder’s office or website. You will need to gather some information as the form requires your Assessor’s Parcel Number and legal description. If a mobile residence you’ll need the Assessor’s Manufactured Home ID Number, and manufactured home description. You can get this information online, or call your agent for assistance.

With that information, completing the form is simple. Check the appropriate boxes, provide your name and the address of the property, and sign it in front of a Notary. After it is completed take it to the recorder for recording and, voila, you have a Homestead Exemption.

Our Advice: We recommend that every property owner file a Declaration of Homestead on their primary residence. It is easy and of nominal cost, but can protect you from the unforeseen and unknown that could wipe out your life’s hard work. Few things in life are so easy, cost so little, and return so much as a Declaration of Homestead. Think of it like an insurance policy – you wouldn’t be caught without it. Take a moment and get it done. Consult your attorney if you have specific questions about your circumstances.

Opportunities to invest your money come in many varieties. Some are safe, low return situations, while other have more risk and afford greater return on the invested dollar. Some are stable over the long haul, while others can change immediately.

Stocks are a good example of the latter. There are many opportunities in the stock market, high or low risk, and each has the commensurate return. We’ve recently seen how volatile stocks can be with GM and the bottom falling out of its stock price. Real estate has dropped dramatically and is a daily headline in the news, but it has taken years for it to drop to half or one third of its peak value. Stocks can be reduced to a fraction of their peak value in a matter of hours.

Some investors choose gold, silver, or other such investments. While they have seen price volatility in the past, there seems to be stability and growth in that area now. How high will they go? That is anyone’s guess and the guesses change with each article or opinion that you read.

Real estate affords a great variety of investment opportunities. You can buy a cash flow, a depreciable property, speculative property, etc., each with its own benefits and risk. Real estate prices have fallen over the past four years, but it is important to recognize that it took that long for the prices to fall where they have fallen to. The extent of the decline was startling, but it wasn’t immediate. In most cases, the recovery of real estate pricing is just a matter of time. Things will turn and the demand will be good.

Demand is always a driving force in investments. High Demand = High Price. While the financial crisis has limited the number of people that can buy right now, there is still a strong latent demand. The population has continued to increase while housing starts have been non-existent creating increased demand. In our beautiful region with the wonderful people and other amenities that make it so attractive, demand from people looking to relocate here will rise again in the future when they can structure their lives to be able to leave where they are. That compounding factor makes our area an excellent place to invest in real estate with confidence.

Depending on the amount and objective of your investment capital, it is important to diversify your investment portfolio. Some investments provide cash flow, others create wealth. It is important to recognize what you wish to achieve with your money and make a plan to get it. Investing isn’t for the faint of heart unless you are getting 1% on your money in a safe harbor. If you are putting your money at risk to achieve substantial gains you must have the “Investinal” fortitude to stick it out. Real Estate Investment in Northern Nevada today can help calm your nerves while your money is so invested ... prices are great and the upside full of potential.

There is always risk in any investment. If you lose value with stocks you will have a piece of paper. If you lose value with gold you will at least have gold bars, coin, etc. If you lose value with real estate you have something, and they aren’t making any more of it. There are many types and opportunities in real estate so you should work closely with your agent to find the right match for you. When you do, buy and go forth with confidence… you’ve made a good investment. No gut wrenching today buying real estate in Northern Nevada.

A Grandpa's View Of A Home Run

The triple is the most exciting hit in baseball, except for the rare inside-the-park homerun. After trailing by as many as eight runs, my grandson's Little League team was catching up having scored four runs in the final inning. Trailing by three, the tying run was at the plate in the form of my grandson. All three had to score due to the five run rule - a stop in the action without a homerun would end the game. The sun that was in his eyes all game long as a catcher and hitter had gone below the mountains. He stepped up to the plate. He could see. The pitch. A swing and a miss.

The crowd had grown as the three other games at the park were over. Baseball aficionados and friends from the other games were lingering to watch this game wrap up. Strike two. Another healthy swing. The kind of swing that appears to be three-quarter speed, the visual effect common to the power hitter as opposed to the quick flick swat of a contact hitter.

There was murmuring in the crowd as the pitcher wound up. The underdogs were ahead and this was the last strike pitch. The pitch. The swing. The CRACK of the bat! As one the crowd inhaled, in awe, as the ball arced high towards right field. Silence continued a moment as the ball began to drop. Then it hit between the outfielders and rolled.

The roar erupted and grandson rounded first. Runner scored from third. Coaches yelling, "Run!" "Throw it!" as they tried to score runs or get an out to end the game depending on which dugout they were yelling from. Grandson rounded second with a bit of a stumble but not a wobble as he clearly had a goal of reaching the pentagon known as home plate.

Another run scored. The ball was thrown to an infielder. The fans were yelling ... some the roar of fan excitement... others pleading/coaching their players to do their will. No drops by the defense. The ball was steadily moving towards home through a series of players. As it was youth play, every throw and catch was in itself a suspenseful act.

Rounding third in fluid motion sped grandson. At a full run with desire in his eyes, he was not going to quit. The throw to the catcher... the turn to make the tag... just a fraction of a second late as the sliding runner had pointed his cleated toe with a perfect low slide that seemed to furrow the basepath until gravity ruled and the momentum was stopped with just a cleat and an ankle where grandson wanted them... safe at home.

Everyone roared and clapped for both sides. The game went an extra inning. We lost the game but all were winners in a bigger sense. Everyone in the Park that night left with a glow knowing that they had just witnessed their child's growth, the education of life values. Perseverance, commitment, discipline, teamwork, and more, kept both teams in the game to the very end. Everyone, too, knew that they had experienced baseball at its best. Two hours of methodical ennui with a sudden explosion of high action and emotion. All were happy to be a witness to and a part of the action.

In a moment's time I went from thinking of the Mighty Casey when grandson had two strikes to watching him rise from his scoring slide and run to his teammates with outstretched arms and a smile that seemed wider than his ears. Regardless of what he does the rest of his baseball career, this 10 year old has a lifetime memory of a grand moment in time... as does his Grandpa. Youth sports are a wonderful thing for everyone - the athletes, their coaches, families, friends and the administrators that work so hard to facilitate the sporting opportunities for them.

Price Versus Market Value In Real Estate

Price Versus Market Value In Real Estate have never been so far apart as they have been of late. Logic would dictate that they would be one and the same, but the reality of today’s real estate market is that they are often far apart. Market Value is considered to be the most probable price that a sufficiently marketed property would bring in an arm’s length transaction between a knowledgeable and willing seller and a knowledgeable and willing buyer with neither under duress to perform. Price can be what someone is asking, or what it sold at – both are “price”.

Market Value is established by Appraisers and Agents looking at recent sales of comparable properties. Agents can also look at comparable listings, what they will be facing in competition from similar properties offered for sale. The ultimate number used by lenders is that of the Appraiser, the one licensed to deliver an opinion of value. Appraisers use sold comps, a snapshot of the market looking backwards. Agents use a combination, see trends, and can adjust the price looking forward. This is an important difference in a moving market, up or down, and can lead to a disparity between Price Versus Market Value In Real Estate.

Price can be anything, but is usually what the Owner and Agent determine they can sell it for. That can be interesting at times. It is important that price has nothing to do with what someone paid for a property. If it were given to them would you expect them to give it to you? If they paid $200,000 more than it is worth today, will you pay them the $200,000? Of course not. Price is what the market will bear given the amenities, condition and location of the property.

We’ve seen some interesting examples of Price Versus Market Value In Real Estate lately. A property listing at 19.5% below an appraisal completed in the same week the property was listed … and it has generated no showings. The price is definitely right to attract a Buyer, but none have stepped up to date even at that great price! Another example ... a bank-owned property. Banks are quite cautious on their values when they sell, but in this case the accepted sales price was 7.5% less than the Buyer’s loan appraisal. Both of these current situations may seem to reflect a declining market because of the ratio of appraisal to price, but does it?

The market is stabilizing somewhat so maybe they are simply prices designed to get the property sold. That would be a willing Seller … certainly a willing Buyer ... but is it Market Value or a Low Price?

Sometimes prices seem too good to be true. Buyers steer clear of the “smoke’n deal” because they think there may be a problem. Conversely, Buyers at times avoid a high priced property when the Seller is just waiting for their offer. Occasionally, a mistake is made in pricing. If it is high, the property sits on the market. If low, the property jumps off the rack as the opportunity is easily recognized by active Agents and their Buyers.

Our Advice: Whether buying or selling, it is important to remember to make your Price Versus Market Value decisions based on your wants and needs, and your understanding of the Market. People buy and sell for many reasons, not all of them immediately apparent.

Don’t get hung up on Price, Comparable Listings and Sales, Rumors, or Anything Else that will keep you from making a sale or purchase that is a great deal for you and your circumstances. Price Versus Market Value In Real Estate ... like Beauty ... is in the eye of the beholder. See it through your eyes, not those of others.

How To Be A Good Real Estate Buyer

Like everywhere, Real Estate Buyers in Northern Nevada come in many varieties, each special in their own right. Some want Nevada income tax benefits, some land for their retirement, others their first home. Each is serious in their quest, and deserving of a good agent to help them achieve it. It is important to understand that being a good real estate buyer can significantly affect the outcome of their real estate experience by doing their part in the process.

First of all, be happy and nice. There can be stress in the real estate process. From the property selection, through negotiation, to the end of the escrow, stress can appear in many ways. Frustration can occur, but anger need not be a part of it. Work to a solution in a positive manner. The solution is the goal, not the emotions or processes along the way. They will be forgotten in time, but the outcome of the transaction will not.

Be ready for action, especially if you are buying a bank-owned or short sale. You can wait weeks or months and then have just a few hours to respond. Fair? Not really, but it is the reality of dealing with those types of properties and getting upset won’t get your escrow closed. A better course of action is to laugh at the absurdity and sign quickly. Action is also important if the “right” property is suddenly available – don’t hesitate, act!

You will incur costs along the way such as inspections. Please, either pay them onsite at the time of the inspection, or, if you don’t close, immediately with the cancellation of your escrow. The work was done for you, not the agent that likely ordered it for you. It will save your agent from having to ask you for the payment on behalf of the inspector. This keeps your relationship intact to move on together and find the right property.

A good real estate buyer is gracious in a home regardless of the occupants’ lifestyle. It is their home, they are choosing to live in the manner that they live. Nice interaction and chit chat can go a long ways to making you a likeable person, helpful during negotiation. It is amazing how often this little part of the process becomes important, especially when there is a tight neighborhood and the Sellers want to leave their community with a good neighbor.

Good real estate buyers do what their agent asks of them.

There will be times when your agent needs you to do something to move things forward. It could be a signature, a selection or decision. Timing can be critical in a real estate transaction. Do what is asked of you as expeditiously as possible in your own best interest. Interestingly enough, one of the most impactive statements an agent can make on your behalf when asked to modify a transaction is, “They’ve done everything you’ve asked them to do! That statement can only be made if you have, indeed, done so. It is a powerful statement that can reap an assortment of rewards for you.

Our Advice: Be candid with your agent. If you are holding back important information your agent can’t do a proper job for you. Don’t worry about hurting your agent’s feelings if you don’t like a property, you are the Buyer! Ask a lot of questions along the way. You’ll get answers, and depending on their quality, will gain confidence in your agent. More importantly, your agent will learn what you need/want to know, or what is important to you. That can help you both as you work together to get you what you want.

Time and effort will be put forth by agent and Buyer to achieve the successful purchase and realization of the Buyer’s goal. Be positive and the results will more likely be positive.

Selecting A Buyer’s Agent in Today’s Real Estate Market

A recent call reminded us that Buyers, and Sellers, don’t always know how to select and use a real estate agent. The Buyer called on a listing, and it turned out he was calling every listing agent on a long list of properties to get information. Commendable for the effort, but not an effective way to use agents for his benefit.

He was driving around neighborhoods looking at signs, taking phone numbers, and calling. Finding a home using that method takes much time, not to mention a lot of gas. There are also many frustrating calls to make trying to connect with each agent to find out the price, bedroom count, and other important information such as distressed status. Even with that time and effort, the hard working Buyer is never sure if he knows the market as the ideal property could have just been listed and the sign put up after the house hunter drove that street.

An agent can look at all of the properties in the Multiple Listing Service, MLS, at once and determine if the price is okay, there are sufficient bedrooms, etc. The agent should interview the prospect to find out his wants and needs in a home so she can offer suggestions as to area and homes. The agent can search the MLS with specific criteria to find the “hidden” gem. Sometimes the idea home is right under everybody’s nose, and it goes unnoticed without professional perspective. Cull the list with the agent and then drive around.

So how do you select an agent?

Looking at their ads everybody is number one at something while others are funny. They are all attractive. You will be working with this person or team for an extended period of time while you find a home, negotiate an offer, and navigate the escrow process, to the end goal, Home Ownership. You don’t have to particularly like them, but you must have confidence in them. Using your Aunt Betty’s grandchild’s wife’s sister’s neighbor isn’t the foundation for a successful relationship. Don’t be bashful about interviewing for a good agent to represent you. They should have real knowledge about what you intend to do.

An agent should be concerned about your wants and needs. They should ask many questions so they understand what you are looking for, or dreaming of. They should ask you about your financial status, if you’ve talked to a lender. What can you afford and what do you actually want to pay? They should stick to your price range, unless they find you what you want for less than you can afford. They should explain the process they’ll use to get you the right home. Different types of homes can require different techniques and timing. They are there to help you, to do the work for you.

Our Advice: Pick your agent wisely. You can find them in the newspaper, from a sign, a referral, or online. Regardless of how you connect, you should become confident that the agent hears you, understands you, is honest and can do the job for you. There are many ways to work with an agent and many agents to work with. Determine your goals and work with a good agent to accomplish them together. When you get a good agent don’t bounce around, you’ll end up with nobody working for you.

Remember, it is easy to search for homes in the newspaper, real estate magazines, and online. Buyers these days often provide a list of homes to their agents who then research the properties’ details for them. That way you can search and interact with your agent about what you find. You’ll be involved in the process and when the right property comes along you’ll know it.

Maximizing Your Price in Northern Nevada

It’s Spring in Northern Nevada and you’ve decided to sell. What do you do to get the most out of your property? Start by putting your Buyer’s hat on and look at your home from a Buyer’s perspective. As you analyze your home consider the following three categories for the deficiencies: 1. Selling Condition, 2. Market Condition, 3. Enhanced Value.

Selling Condition means you’ve met or adjusted to have the home in minimum Selling Condition. If you have a multi-patched roof your home is lacking here. Other items to fix just to achieve Selling Condition can be the removal of debris on your lot, broken window seals, plumbing leaks, etc. If you are selling short don’t worry about it, the Buyer and lender will adjust the sales price for these deficiencies without cost to you.

Market Condition is simpler, mostly involving cleaning and decluttering. You’ve naturally got many personal touches around the house, it is, after all, your home. The Buyers aren’t coming to judge your lifestyle, they want to see how theirs will work in your home. Take down the family pictures and box the knicknacks, you’re moving anyway. Empty your overstuffed closet or they may think its smaller than it really is. Its Spring, you can pack up your winter clothes. Likewise, if your kitchen drawers are stuffed with used-once-a-year gadgets they’ll think the kitchen is too small. Declutter.

Clean well. Nobody wants to live in a dirty house even if their lifestyle is such that it will be dirty soon after they move in. They want to live in their own dirt. Remember to clean the outside, too. That is your first impression and you want it to count the first time. Should you stage your home professionally? Good stagers do wonders and can yield great results, but they come with a price. Is your price point such that you can absorb their cost and profit from it?

Getting your home to Selling or Market Condition will add value, but there are times when you can Enhance Value. This can get tricky. Are you better off putting in new carpet or giving an allowance? Should you give an allowance or reduce the price? When you consider any change, or addition to sell your home question whether it will get you a higher sales price. If not, don’t do it. Your home will sell by its features, location, character and … price. Price sells more than anything else in this market. If you put money in a remodel be sure to figure what it will return. There can be a great return, but if you are trading dollars, don’t do it. Your agent can help you with your analysis.

Our Advice: You can spend months or longer getting your home perfect, but what is perfect to the Buyer? We’ve seen lovely homes in great shape that the Buyer is going to “gut”, do a major remodel on. Keep your eye on your objective. What are you going to do after you sell? If you are buying elsewhere will you lose a buying opportunity while you take the time to try to get a little more out of the home you are leaving? Selling? Ready…Fire…Aim! Get it ready and get it sold!

An increase in either rates or prices can affect your next purchase and offset any gain you may have worked for.

Tales From The Short Sale Trenches

With two thirds of the local Northern Nevada listings being Short Sales today, it is important to know what is going on in the World of Short Sales. It is especially important to remember that each Short Sale is unique unto itself and these stories shouldn’t keep you from buying or selling such a property. Remember, forewarned is forearmed. Seller’s circumstances vary, the lenders and their investors vary, the market changes, etc. There is no one formula for success.

While many Short Sales go through handily, there are those that defy logic, reason, and sanity. We had one such situation last week causing us to call a U.S. Senator for assistance. What caused such a drastic action? Consider the facts. On December 30th we received a Short Sale approval letter providing that escrow close by February 21st. No problem, everyone went in to action and we are well on our way to closing. On January 18 we got an amended Short Sale letter saying we had to close on January 25th. Whoa! What’s going on?

Correspondence with the lender revealed it to be a FNMA … Fannie Mae … requirement and they will not postpone the Trustee’s Sale (foreclosure) which is scheduled for February 2nd. The Buyer’s lender said she can close on the 4th, but no movement by the bank until January 24th when they said we had until January 31 to close. This with a Seller expecting her fourth child on March 1st not knowing if, or when, she is moving. For the sake of a couple of days there may be another bank-owned property in the neighborhood.

We had another dandy experience with lender Short Sale lunacy last week. Here’s the back story – Listed at $235,000. No action until priced at $189,000. Two offers – one at $184,000 and one at $165,000. Bank counters $197,000 which is accepted. We motor along getting ready to close when suddenly the bank comes back with a price of $250,000, a requirement of the investor. Clearly, the home is not worth that kind of money.

We assemble information to show value, confirm with all parties that they are at their maximum price and contribution and go back to the lender. The lender accepts the original deal, which was theirs in the first place, and we continue on for a couple of days. The bank comes back at $222,000 from the investor … Fannie Mae … with no give. The market just isn’t there, but the investor is locked up. Had to get some tricks out of our sleeves on this one … we’ll see if they work.

Our Advice: It is amazing how belligerent the investors are becoming. Yes, it is their right as it is their money, but it seems senseless for them to negate viable Short Sales only to acquire the property via a Trustee’s Sale. They seem to be forgetting the human side of things – the homes that are being destroyed and the incredible emotion that is tearing at so many people these days. Most sellers are victims, not strategic Short Sellers. They are selling short because they have to. Whether job loss, divorce, illness, transfer, or any other valid reason, it is beyond their control. Had prices not dropped they could sell and move on with their lives. With the market being what it is, they have no choice but to sell short or let it go. When they opt to sell short they don’t deserve the emotional roller coaster that is thrust upon them by inconsiderate lenders representatives.

Stay strong in your Short Sale. It can be maddening, but stay the course and you will be justly rewarded. When it comes to choosing professionals to assist you with your real estate needs…

Under All Is The Land

So begins the Preamble to the amazing Realtor Code of Ethics. Read carefully, it contains some powerful statements. Under all is the land. Upon its wise utilization and widely allocated ownership depend on the survival and growth of free institutions and of our civilization. REALTORS ® should recognize that the interests of the nation and its citizens require the highest and best use of the land and the widest distribution of land ownership. They require the creation of adequate housing, the building of functioning cities, the development of productive industries and farms, and the preservation of a healthful environment.

Such interests impose obligations beyond those of ordinary commerce. They impose grave social responsibility and a patriotic duty to which REALTORS® should dedicate themselves, and for which they should be diligent in preparing themselves. REALTORS® , therefore, are zealous to maintain and improve the standards of their calling and share with their fellow REALTORS® a common responsibility for its integrity and honor.

In recognition and appreciation of their obligations to clients, customers, the public, and each other, REALTORS® continuously strive to become and remain informed on issues affecting real estate and, as knowledgeable professionals, they willingly share the fruit of their experience and study with others. They identify and take steps, through enforcement of this Code of Ethics and by assisting appropriate regulatory bodies, to eliminate practices which may damage the public or which might discredit or bring dishonor to the real estate profession. Our Advice: The lofty ideals in the Preamble set the stage for the Code of Ethics itself. The Code is comprised of Standards of Practice and Codes that all Realtors must abide by or be subject to sanction or removal by the Board of Realtors. Read them and you will understand the strength of a Realtor. Not all agents are Realtors. Code offenses should be reported, whether by a member of the public or other Realtors. It is how the ideals are maintained and the public protected and better served.

Northern Nevada Short Sales vs. New Short Sale Rules

New Short Sale guidelines were just released for the Homes Made Affordable, HAFA, program. They take effect on February 1st, and loan servicers have been encouraged to implement them as soon as possible. The HAFA program was originally instituted to help expedite the Short Sale process, but the results have been abysmal. The new changes are intended to change those results.

The new guidelines are quite varied, each addressing a weakness in the system. Interestingly, the Loan Servicers are no longer required to verify a borrower’s financial information to determine if the total monthly loan payments exceed 31% of the borrower’s monthly gross income, but they must verify the borrower’s hardship. Each Servicer may include a requirement on their own that borrowers provide updated financial information. Another significant change is that there is no longer a minimum distance requirement for how far a Borrower moved to cause a problem holding the property. Also, the Borrower’s reason for relocation does not need to be connected to re-employment or transfer of employment.

The property must be or must have recently been the Borrower’s primary residence. Now a property that has been vacant or rented to a non-borrower for less than 12 months prior to the date of the Short Sale Agreement is eligible. The 6% cap for payments to each subordinate lien holder has been removed. The Servicer can determine the amount or percentage of the unpaid lien that will be paid to each subordinate lien holder up to a point where a $6,000 aggregate cap has been reached.

The lender must communicate an approval, disapproval, or counter within 30 days of receipt of an executed sales contract. This should help reduce the number of Buyers that walk away out of frustration with past delays. The Servicer may not charge vendor fees against the listing broker’s commission. Also, the real estate commission paid shall be the amount indicated on the listing agreement, not to exceed 6%.

The HAFA program does not apply to Fannie Mae, Freddie Mac, FHA, VA, or USDA (Farm Home Loan) loans. Servicers are not required to implement the new terms to any loan reported via the HAMP Reporting Tool, or for a borrower already determined ineligible for HAFA, but they are allowed to reevaluate borrowers using these guidelines.

Our Advice: Short Sales constitute 30%, or more, of the Northern Nevada Real Estate Market right now. Short Sale nightmares are real, but many go through just fine with minimal hassle, just a lot of hard work on the part of your agent. Don’t decide whether or not you are going to sell or buy a home that is selling short based on what you’ve read or heard. Take your specific situation to your agent and discuss it thoroughly. Many factors come in to play including the lender involved, the property value perceived by the investor, the Sellers circumstances, Buyer’s circumstances, and more. These new changes will have a positive impact on the success probability of many potential Short Sale properties. Check it out – you might find great results for your situation, both Buyers and Sellers.

Measuring Square Footage

Homes in Northern Nevada are generally sold on the basis of Square Footage. In other areas emphasis is put on “rooms”, how many rooms are in a house. We feel that can be misleading as room sizes differ with the property. You can have different sized bedrooms or dining rooms offering dramatically different utility of the home. The total Square Footage under roof, however, gives one a good idea of the extent of the living area improvements. If there is enough minimum square footage the Buyers can look at the floor plan, how the home is laid out and how it will work for their intended use.

With square footage being so important, it is critical to get accurate measurements. This can be easier said than done on some properties where the property can be measured by the Assessor, Agent, Owner, Appraiser, or Buyer and you may end up with five different measurements. The difference isn’t always in the math, it can be a sag in a measuring tape, a fraction that is treated differently, a mistaken interior garage wall location determination, etc.

Understanding how a home is measured is critical. All measurements are from the outside of the house. When determining Square Footage the agents are seeking to establish the “Living Area”. Living area is space intended for human occupancy, a definition which helps to understand why there are minimum height requirements, requirements for a finished interior, that it be directly accessible from other living area, and that it be heated by a conventional, permanent heating system.

It sounds simple, but there will be discrepancies on how a tape measure is read, conversions from inches to decimals, how to treat a bay window (to be included it must have a floor and a height of 7 feet according to some standards), and bonus rooms over garage with sloped ceiling (slope can’t meet the floor, height at least 5 feet, at least half of room with minimum height of 7 feet), and second story of a two story open foyer (should be excluded from square footage – is good cubic footage which applies to utility and aesthtics, but not square footage.) Beware, too, of above and below grade value differentiation, separate guest quarters being included in the main dwelling Square Footage, and the “bonus” room language. Commonly called a bonus room because it isn’t a family or living room and is extra Square Footage of good utility, a bonus. It is not a true “bonus”, however, as in “something in addition to what’s expected”- you are paying for it.

Our Advice: It is important to understand this as in our area Square Footage is second only to Location as a contributing factor in making a home buying decision. Not only does Square Footage assist in the preliminary determination of a home meeting a Buyer’s space needs, it also provides an easy means to estimate a home’s value using comparable property sales. Make sure you understand where the Square Footage you are relying on came from. Many local agents use Assessor’s Office figures when listing properties. Those were measured by professional appraisers and are usually accurate unless the home has been modified. If the size is being determined from plans understand that the as-built product can differ from the plans. One should always measure for peace of mind.

New How-To Home Buying Videos were just release at the National Association of Realtors

Three new how-to home buying videos were just released at the National Association of Realtors Convention in New Orleans. HUD produced the three consumer education videos in coordination with NAR. The videos help educate the consumer on shopping for a home they can afford, a mortgage they can sustain, and what to expect when its time to close escrow.

“Educating consumers about the home buying process is at the heart of what Realtors® do,” said 2010 National Association of Realtors® President Vicki Cox Golder at the video release announcement. “Informed home buyers create the conditions necessary for responsible, sustainable home ownership, and we’re very happy to be a part of this project.” Here’s a summary of the three videos:

Shopping for your Home – The home buying process begins with finding a place you’ll want to call home. This video instructs viewers on assessing how much of a home they can afford, how to work with a real estate agent and what happens once they find the home they want to buy.

Shopping for your Loan – Once you’ve found the right home, the next step is to shop for a loan. This video helps consumers use the good faith estimate (GFE), a form that spells out the terms of a loan offer, to shop for the best loan for them. Consumers learn how to use the GFE to determine how long an interest rate is available for a particular loan and how to identify key loan terms and costs of a particular loan offer.

Closing the Deal – This video walks consumers through the actual closing process including how to make sure the loan they were offered closely matches what they receive. Of particular interest, HUD will walk the viewer through the HUD-1 Settlement Statement and demonstrate ways for the consumer to compare their actual costs with those on their Good Faith Estimate.

The videos are accessible from both HUD and NAR’s websites. Additionally, HUD has a youtube site that is easy to use, www.youtube.com/HUDchannel. They are free, informative, and could make a difference to you in your home buying process. Check them out. All it takes is one good bit of information that helps you in your home buying undertaking to make the time worth your while.

Our Advice: First time home Buyers will find these videos informative and helpful. During the release announcement, a HUD spokesman said, “These videos go a long way in identifying key aspects of the home buying process that a consumer should be aware of. Our goal is help make the process more transparent through educating consumers who in turn can make informed choices about their home purchase. We partnered with NAR because a real estate agent is often the primary point of contact for homebuyers and we believe real estate agents are in a great position to provide these videos to their clients as they move through key areas in the home buying process.”

Between the videos and your good agent you’ll have a more informed and therefore a more confident, pleasing experience. So pop some popcorn to watch the videos with, and get ready to buy a house! Prices and rates are great! These are the good ole days – don’t miss out.

Reflections Of Thanks And Gratitude

This is the time of year for giving thankful reflections of gratitude and we have many. We are thankful for the ultra low interest rates helping so many right now to buy or refinance. We are thankful for realistic Sellers; Buyers buying with confidence; Real estate agents that are helping Buyers and Sellers gain perspective to navigate these challenging times and not whining as they help them accomplish their goals; The deliberate efforts to understand and effect Short Sales by Sellers, Lenders, and Buyers.

We are thankful for the renewed opportunity for young families to obtain home ownership and enjoy the American Dream of home ownership due to the low prices today; For the young people that are having the confidence to step up and buy a home; For the loan programs available to them that, combined with the current low interest rates and low homes prices, make for a truly magical buying experience. We are thankful for cooperative lenders that understand Borrowers are often the victim of circumstances these days and are treating them with more compassion and understanding. Many governmental agencies and departments have adjusted their practices in recognition of the need for leniency by developers and builders and we are thankful for their understanding.

We are thankful for the natural beauty and wonderful people of our communities; the wonderful life enhancing opportunities available for our children such as Pop Warner football and cheerleading and the many other superb youth organizations filled with great civic-minded volunteers; We are thankful that the Youth are still and always important in our communities, and that Values are respected and a way of life for most. We are thankful for our many Seniors that stay active in the community and impart their experience and wisdom along the way so we don’t lose our way. The large network of compassionate social services for those down on their luck is something to be truly greatful for.

We are thankful that we can still enjoy free concerts in the park; That people still stop to help one another; People still say hello to strangers with a smile. Drivers are courteous – let you in rather than cut you off. We are thankful for the incredible strength of our community as we suffer together the sickness or passing of loved ones and help them recover or celebrate their life; The right to vote and the many freedoms we enjoy in this great country of ours.

Our Advice: Be thankful for your health, your family and your community. Be thankful for the strength and understanding to carry on when you have a hiccup in the well-being of one of the above. Be thankful for the ability to learn the lessons coming to you during such times, and the good that will result. Every cloud has a silver lining … every cloud. Be a shining example of gratitude and be thankful for what is … not resentful for what isn’t. The real estate market is what it is today, not what it was yesterday, or what it will be tomorrow. Be thankful you can establish your priorities and keep the reality of real estate challenges you might be encountering in perspective – its only money and, thankfully, you can get it back. You can’t get back health and the time with your family so be thankful you can keep them both strong now while you weather the storm.

These are the good old days… be thankful we can share them together. We are very grateful to have so much to be thankful for. Tales From The Trenches in Northern Nevada Real Estate

Frustrated or confused in this market? Consider some of these recent experiences, all true stories. Think your lender is giving you fits? How about this one – A couple was looking to refinance their home to take advantage of the new low rates. They were seeking $100,000 on an appraised value of $360,000, 28% Loan to Value. Their credit scores, husband and wife, are 840 and 820 (not a typo) respectively. They were turned down. Why? The stated reason is because they are tearing out their deck and replacing it with a patio, and they used two pieces of siding on their expansion that didn’t match the rest of the home. This is the same asset that the company is already using to secure a higher rate loan. True story. Think the lender didn’t want to give up a higher rate loan? They are appealing to upper management and to their Senator.

We had a Buyer write full price on a bank-owned property. Excellent agent on the other side, no problem, right? Fourteen days later the madness continues. Some adventures along the way: Lender countered with 10% down to a Buyer that is getting a 100% loan. The next Counter they allowed the 100% loan, but said the transaction wasn’t conditioned on the Buyer getting a loan. The last go ‘round included the bank removing the agents’ selling fees. Sound like the asset manager was punching the wrong buttons on the portal, or simply didn’t know what he was doing? Either way, the Buyer has been on an unnecessary roller coaster ride.

We wrote full price on another bank-owned property. They countered one item because “they had to” – the close of escrow. They extended it from 15 days to 30-plus. The Buyers went along and we proceeded. A week later the bank started requesting an early close. They had it to begin with, held up the acceptance to counter with an extended closing, and then reversed their course. This after they took days to accept and then demanded acceptance within 24 hours. This last item is very common these days with bank owned properties.

Then there’s the ex-wife that won’t sign docs for a short sale. Refused to cooperate. She recently went to buy a new home and is running in to problems with her loan because of the late payments on her old home that the ex got in the divorce. They could have been minimized if she would have cooperated 9 months ago when he was current but struggling! She’s threatening suit on the ex-husband because he couldn’t make the payments after he lost his job. Remember, they bought the house on both of their incomes, he now has zero income. Hmmm – what’s a judge to do?

Our Advice: These are just snippets of what’s going on around town. There are many, many more examples that are simply jawdroppers. Hard to believe, but it is the reality and must be dealt with. Whether buying or selling, it more important than ever to have a good seasoned agent to help you navigate this tumultuous Market. It is important to stay calm, stay focused, and proceed to your objective. Things are really quite exciting right now and you can be a part of it – just be ready for surprises.

Keep your eye on your goal and don’t get emotionally wrapped up in the brushes of insanity you’ll experience along the way. Make sure it doesn’t rub off on you and you’ll be just fine. The end game is what counts for you and your family – remember that as you laugh at the ludicrous scenarios that unfold before you and you’ll have fun while you succeed. A good way to live.

Real estate is personal, it's about what your wants and needs are. Despite what you read, see, or hear in the media, or at the water cooler, be sure to understand that those comments may, or may not, apply to you. What do really want? If we all had the same wants we'd all drive the same car, wear the same clothes, and live in the same two story home.

Your real estate endeavors are really about you ... and only you. It doesn't matter what your neighbor did, or what somebody in Timbuktu did, it's about your wants and needs and your ability to achieve them. Think about it - you meet with your agent and tell them what you want. Sometimes you tell them what you need, but do you ever tell them what you really want ... your dreams? Isn't your goal to live your dream? Share your optimum goals with your agent, how you envision your life in your new home, and how your life will be. You will be amazed how much quicker your dreams will become reality.

This applies to Sellers as well as Buyers. As you contemplate your sales process, consider the probability of your sale, how your move will go, and the benefits afforded to you by the sale of your property. Forget the price that you didn't get four years ago, what counts now is what you are doing now. If your goal was to sell then you would have. If your goal is to sell now ... you will. Look past price ... to your real goal in selling. The bigger/smaller house, new neighborhood, or the debt relief. Whatever it is, it will be, if you focus on what it is you really want to result from your sale.

Think about the details of your vision - the dog pen, the color of the granite, the neighbors, the flowers, cash in pocket before you move out, clean inspections, friendly counterpart in the transaction - Buyer or Seller, etc. Don't get paralyzed by the minutia causing you to miss a good opportunity, but likewise, don't be surprised if it becomes a reality in your life because your had it as a goal. If you have twenty specific items that you want in your new home, or in the sales process of your present home, and you get eighteen of them, you are much better off than if you had three and got two. You are truly getting much more of what you want in your life, achieving more of your personal goals.

As you look at the real estate market, be sure to consider what you are looking to achieve before you respond to rumors, media goings on, and your neighbors' experience or philosophy. Despite the many media stories, neighbors' hype, or any other influencing factor that may cause you to make an emotional decision, be strong and steady in your decisions for your real estate benefit. Your agent will help you with perspective, but your agent isn't living in the house you are buying or selling. Take the information, process it, and live for you.

There are many factors that affect your ultimate happiness. Prioritize them and work towards those most impactive on you. Decide accordingly and you'll be happy with the results.

Legitimate Negotiations Or “Gotcha” Real Estate

Things change in a real estate transaction as it runs its course, you can count on it. Most people enter the transaction taking everything at face value – what you see, or perceive, is what you are receiving. There are as many components to a transaction, however, as there are systems to a house, and just about anything can happen. As things happen, there can be a need for an adjustment by one or both parties. When everyone contracts with integrity, and is committed to keeping things on a par from the base agreement that the parties originally agreed to, everything works out well for all parties given the changed circumstances.

In a changing transaction make sure that you understand the extent of the “new” thing and what it means to you. If an inspector finds a window with a broken seal you don’t need to have every window in the house replaced. You have a nominal repair, not many thousands of dollars of remodeling. Asking for the windows to be replaced in such a situation, as incredulous as it may seem to most readers, happens. It may be disingenuous, or predatory, but it happens. Not good and the request is not warranted or valid.

Be sure your agent understands what you want in your transaction, and that you understand your contract. Do you want the Seller to pay for recurring and nonrecurring closing costs up to a certain amount or percentage of the purchase price, or are you instructing your agent to have the Seller pay for all the closing costs? There is a big financial difference – be clear in your communication and understanding. You have a responsibility to know what you want and to communicate it to your agent so he can work effectively on your behalf. Not telling your agent exactly what you want in a transaction is like telling the doctor, “I hurt doc, find it.”

Real estate form contracts are written with plain, easy to understand, language. They cover many topics with clauses that have evolved from decades of litigation stemming from misunderstanding or abuses. Don’t invite litigation or cause it unnecessarily. Be clear about what you want, make sure that your contract addresses your wants and needs so you can achieve your objective. When things change, don’t look for the gotcha, look to the contract details to see how you are protected and what your options are as you move forward.

Our advice: What was your intention when you signed the contract? When you sign your name on a contract you should mean it. Its about integrity. Cheating people out of a few dollars will leave you miserable from not only the bad feelings of the other party, but the innate shame and guilt that will reside within, consciously or subconsciously. Were you planning all along to come back and nibble, or do you have a real concern about something new in the transaction? Do you think a gotcha is okay when it comes to money – the quickest machete wins? Do the right thing and you will benefit in many ways – most of them not known at the time you decide to do the right thing. When transactions go sour by parties looking for the “gotcha” in a transaction, the joy leaves the transaction and so do many of the subtle benefits that are forthcoming when everyone gets along and continues to give as they approach the close of escrow. Continuing to give can be leaving the riding mower without it being in the contract, overlooking a missed deadline and staying committed to the other party, etc.

The best transactions are win/win – both parties benefit! It isn’t always about price – there are many ways to balance the “win” factor in a transaction other than price. The art is to find out what the biggest “win” is for your counterpart so your win comes with less of a loss from your win criteria. Choosing An Agent in Northern Nevada … Ask A Lot Of Questions

Whether selling or buying real estate in Northern Nevada, you’ll undoubtedly find the services of a Professional Real Estate Agent invaluable. There’s a reason the most savvy and successful investors always use good Agents. Good Agents not only get the job done, they keep you safe along the way. The art is to find a good professional Agent.

The biggest ad, the biggest claims, or being the biggest pest does not the best Agent make. Ads cost money, but many agents use them to simply “buy” business. They look to attract new customers for any property, not the listing they are purporting to advertise. If there is little or no inventory in the ad then it is clearly image advertising. Important for business to an extent, but understand it for what it is.

Virtually every agent is Number One at something. There’s the top producing agent types that you are seeking and then there’s the qualified Number One, like “the #1 listing agent that has seven grandkids, owns a black and white dog, and two cats”. What is really important is an agent’s production, and more importantly, their production for the type of property you are buying or selling. If you want a horse property with water rights on ten acres you don’t want to hire a condo specialist, and vice versa. Yes, in our region many agents are truly diverse in their knowledge and experience and can actually professionally serve those extremes, but you must be certain for yourself that the Agent you are working with is capable.

So how do you select an Agent? Initially, you will have some method of introduction. It could be a referral from a friend, an attractive ad, or an internet website. You might just walk in the office and meet a stranger. Once you’ve made contact, understand that you are both interviewing one another. The agent should be learning about your wants and needs, what it is that you are looking to accomplish. They should probe, ask you questions. You, too, should be asking questions … many questions. Do they handle the type of property that you are looking for or selling? What is their experience – both in real estate and in dealing with the type of property you are working with? This is especially important if you have a need for specialty knowledge, i.e. – short sale, bank owned, water rights, floodplain, seven figure price range, ag-deferred property, remodeling, etc.

Our advice: Not all Agents refrain from venturing in to the unknown … potentially at your expense. You don’t want a lawsuit to get what you want, you want good professional service. Ask a lot of questions. You should be able to get references from the Agent, the names and contact information for other people that had a similar situation that the Agent successfully assisted. Learn about their business. What areas do they work? How many listings do they inventory? How many listings sold? How many short sales have they closed? What is their typical List Price:Sales Price ratio? While asking your questions observe the answers closely. Are they appeasing you, or are they heartfelt.

One of the most important things you should look for in an agent is that they will work for your interest, not theirs. It is your real estate… they are facilitating your transaction. Some let their preferences, or needs, get in the way of the customers’ which can cause you to miss your ideal opportunity. Don’t be a victim to a self-serving incompetent agent – it’s your money on the line! We’re proud of our work and Our References. The other good agents are as well. Deadlines Are Approaching Fast

Timing is everything in life, and it is absolutely essential for successful real estate transactions. Some things you have no control over, but there are many aspects of the real estate transaction that you can control. There are several deadlines or events approaching that may have a significant effect on the success of your transaction.

If you are a First Time Home Buyer, or replacing your primary residence, and looking for the Tax Credit, the deadline for being in contract is about a month away. You must have a signed contract by April 30th. To qualify for the Credit, you must close your escrow by June 30th. These are important dates – especially if you are shopping for a Short Sale property as those can take time to position for closing.

Some lenders are doing a very responsible and responsive job processing their Short Sale requests. Some lenders, however, take forever. The risk is too great for you to wait to close with “forever” lenders if you are counting on the Tax Credit. Caution – look at your transaction in its entirety without getting too wrapped up in the Tax Credit. If you are buying the property $20,000 under today’s market, that is better than buying something at market and getting an $8,000 Tax Credit. You might want to hold on to your deal even if you realize that there is a good chance you will be closing after June 30th.

HAFA is coming. On April 5th the new Home Affordable Foreclosure Alternatives Program will go into effect. HAFA provides incentives to both the lender and Seller in connection with a Short Sale or Deed in Lieu used to avoid foreclosure on a loan eligible for modification under the HAMP program. For example, Sellers will be given $1,500 relocation assistance. Under HAFA, if a Homeowner is found to be either ineligible for mortgage modification under HAMP, or been ruled unable to sustain payments under a trial plan, the lender must offer a short sale in writing to the homeowner within 30 days of either of the above occurring. HAFA will expedite Short Sales for those loans that qualify. Under HAFA, the lender must make a decision to accept the qualified Short Sale within ten days of receipt of a written offer.

If you are considering a USDA 100% Guarantee loan be advised that once the existing money pool is disbursed there is uncertainty as to when additional funding will be available. If you need/want that loan program to buy your home we highly suggest that you act fast in buying your home and getting your loan process underway.

Our advice: If you are buying or selling real estate today it is important that you pay attention to real estate news daily. Things change and your real estate success could be directly affected by a new program, the expiration of an old program, etc. Interest rates are rumored to be going up. Knowing that you can decide if you want to buy now … or wait. Your agent is working hard to stay current with events and trends and how they affect you so be sure to keep in close and frequent contact with your agent. Call your agent – ask if anything new has happened since you last talked that affects your situation.

If you are a Seller be assured that Buyers are buying right now. A Buyer? These are the good old days! Who thought we would ever see prices like this again? Don’t time the market drop … that’s like catching a falling knife. Buy the home you want at these great prices and interest rates and enjoy it. There is so much opportunity out there – embrace it. Buyers Can Help Themselves During The Course Of Escrow

Congratulations to you Buyers that are in escrow. Great price and great interest – it is a great time to be a Buyer. To make sure your buying experience is smooth and successful there are some ways you can help yourself through the course of your escrow. It isn’t automatic that escrows close, and it is important that you help yourself along the way to make sure that yours does.

One area that causes delays, and frustration, in escrow is not having all the documents signed, or signed in a timely manner. There are many, many documents to sign during the course of negotiation, escrow, loan, and closing. If you are asked to sign something, something you agree with, make a point to sign and return it in a timely manner. If you have questions, ask them right away and get your answers. Don’t delay your performance because you are not happy with, or are questioning, something.

If you are getting a new loan, don’t make any purchases without talking to your lender. We’ve seen a simple new $1,500 credit line at a department store blow a Buyer’s ratios and almost cause the Buyers to lose their new home. Without a private money swing loan they would not have been able to buy their home … this news coming in while the Sellers are actually loading the moving van anticipating closing the next day. Credit will be rechecked before funding. If you get a new credit card, buy a new car, etc. you can jeopardize your loan.

When you get your inspection reports – read them and make your repair requests immediately. Repairs must be ordered, tradesmen scheduled, re-inspections made. A delay of a couple of days can cause you grief at the closing end.

How is your communication with your lender? Are you talking about locking your interest rate? Do you know your rate … for sure? A shocking higher rate when you are ready to close, even if you can qualify and make the payment, is not a pleasant experience – especially if it could have been avoided. Are there pre-doc conditions? Pre-funding conditions? If so, get them handled as quickly as possible as things will be delayed until you do.

Be available to your agent, be responsive to your agent, talk to your lender, stay active. You don’t have to be alert 24/7, but don’t go underground. If you travel stay in touch. With email and faxes it is easy to get documentation to you most anywhere on the planet in a timely manner.

Our advice: Delays in your actions can lead to a delay in the close of escrow. These days there are new potential delay factors that we must deal with. The appraisal may be reviewed. The underwriter may initiate an unexpected and unexplainable hurdle that must be dealt with. You can’t control those items, but you can control your actions. Be timely, pay attention, keep smiling, take action. Be sure to bring certified funds to close the escrow, i.e.- cashier’s check or have the funds wired, no personal checks.

Remember to set up your utilities for the close of escrow. If the Seller schedules them to be turned off you might be without power, gas or water for a few days. It’s the details of the transaction that will help you maintain your peace of mind as you move towards home ownership … pay attention to them for your own sake. Truth In Lending Changes Take Effect July 30, 2009

Predatory lending practices played a large role in the recent global economic collapse. Those practices included funding loans with falsified information, hidden costs and charges. They also packaged subprime loans as prime loans and resold them to international investors. The resulting negative ramifications have been felt globally as the investments proved to be not what they appeared to be ... for the investor and the borrower. That has resulted in an assortment of laws and/or guidelines, Federal and State, intended to protect the consumer and the investor the latest of which takes effect on July 30th.

The new Truth in Lending Regulation (Reg Z) changes take effect for loan applications filed on, or after July 30, 2009. The new requirements apply to all mortgages secured by a primary or second home. Investor loans are exempt. Two main changes are the requirement of the lender to give a good faith estimate of loan costs within 3 business days after the loan application (early disclosure), and the lender may not now collect any fees before the disclosure is provided, except for a reasonable credit report fee.

More Reg Z changes: a) The escrow may not close until after a 7 day waiting period following the consumer’s receipt of the early disclosure., b) If the annual percentage rate (APR) increases by more than 0.125 percent from the early disclosure amount, the lender must provide a corrected disclosure and wait an additional 3 business days before closing the loan. It is important to understand that the APR not only includes the interest rate on the loan, but certain other settlement costs. c) The consumer may modify or waive both waiting periods for a documented personal financial emergency, with some restrictions.

It is important to understand that the APR can be affected by something seemingly innocuous, but with the potential for major consequences. These can include an unlocked interest rate, a change in the loan amount, a product change (the loan product), rate re-lock due to market improvement, change in closing date, and changes to fees including settlement fees. Each of these items can occur innocently enough during the course of an escrow and, if too close to the scheduled closing date, can wreck havoc with the closing timing. Sample simple problem- if you put a home equity loan on during the transaction the initial disclosure period starts all over. With a home equity line of credit there is no impact.

Our advice: The changes aren’t really burdensome, but they have the potential to delay escrows. It is important that everyone – borrower, Realtor, and lender – all pay attention to the details from the onset of the loan process to the funding. Minor changes can cause several days of delays. Delays can result in missed closing dates which can mean not only not moving on the weekend that you have arranged for with your friends and work, but can also mean a breach of contract that could cause you to lose the property in certain circumstances. All parties must be diligent in their efforts and communication on the loan and escrow process to minimize aggravation.

Getting a new loan? Better plan on at least a 30 day escrow period, and be diligent during the process. The longer the process goes the more opportunity there is for a “stick to meet your spokes”. As changes occur during your escrow make sure of their consequence, if any, on your loan process. Potential Nevada home buyers or those seeking to remodel homes built before 1980 should be aware that asbestos materials may still be present. This should not make you jump out of your chair because asbestos exposure can be easily prevented by taking simple precautions. Citizens of this great state are striving to move to a green lifestyle by advocating environmentally sustainable methods to be used throughout the state.

Asbestos

In most situations, any suspected asbestos should be left un-disturbed. Sometimes the best action is no action at all. When asbestos materials become disturbed, broken down or friable, this is when it becomes a concern, as fibers can become airborne and presents a high risk for anyone in the area.

The inhalation of its fibers can cause a rare lung-ailment known as mesothelioma, which accounts for three percent of cancer diagnoses in the United States. That is what groups such as Environment Nevada focus exclusively on.

Recently, congress passed the American Recovery and Reinvestment Act into law. Included in this act were extensions to the tax incentives placed for energy efficiency in 2005, as well as new credits for homeowners who remodel or build using eco-sustainable methods. Some of the measures that are eligible for tax credits include added insulation to walls, ceilings, or other part of the building envelope that meets the 2009 IECC specifications, sealing cracks in the building shell and ducts to reduce heat loss. Storm doors paired with U-factored rated wood doors are also eligible.

The use of recycled building materials such as cotton fiber insulation can reduce energy use by 25 percent. The implementation of eco-construction, alternative energy solutions and energy reduction solutions has continued to play an important role in the transformation to a healthier and sustainable world.

This Saturday in Carson Valley was special, it's "Carson Valley Days" ... a 99 year old tradition of celebrating our wonderful Carson Valley Life! We started with the Carson Valley Day's Parade. After that, amid the confusion of taking apart the Douglas Pop Warner Float, I met with my young home buyers to open the house and let them share their future new home with their extended family and friends!

What a wonderful joy to watch them show their parents, aunts, uncles, children and friends the home they will soon be moving into!

Short Sale Update … Are They Working … Worth It?

The Short Sale has gone from something that few practitioners had ever heard of to a commonly used real estate term. When they first became popular they were nearly impossible to implement. Lenders were so hard to work with that most Short Sale efforts were for naught. Things have changed considerably to a point where they are feasible though not for the faint of heart.

The Seller must provide substantial information to prove need including a Hardship Letter, Financial Statement, bank statements, paycheck stubs, tax returns, etc. The Lender wants to know what changed the borrower’s repayment ability, and if there are other assets that could be used to repay, i.e.- cash, stock holdings, other real property assets. This takes work, but is required and worth it.

We’ve learned a lot in the past eighteen months about doing Short Sales. It used to be frustrating when the lender would say that we weren’t authorized to talk to them even though we had submitted the correct paperwork. It was frustrating when they said they had not received our FAX transmission of the documents. This was common, and done repeatedly – we would send each package, all 60-plus pages, three times. It didn’t matter who the lender was, this is what the agent encountered. We now know that they are taught how to get agents off the phone as quickly as possible and those were two of their best techniques. With this knowledge we know to stay the course on the phone, ask for a supervisor and ultimately they will find everything to be in order and we can proceed with the business that needs to be done. It is one way that agents have achieved a higher level of success in implementing Short Sales.

There are scavengers hovering over distressed property owners so be careful who you agree to work with and what services you agree to pay for. There are those that are trying to tie your property up with an option at a low price while they try to flip it in a double escrow. No, it isn’t legal, but it is a predatory practice that is presently occurring. Other services are being offered with the understanding that the lender will pay for them. The problem is that the lender won’t pay for them and the already cash-strapped Seller has to pay. Yet another scammer offered to tell the Seller how to cure her loan that was in default for $5,000. She paid – the advice, “Pay your loan current.” True story.

Our advice: Sellers can realize great benefits and Buyers can get a very good price with a Short Sale transaction if you stick it out and allow it to work. Make sure the Listing agent is Short Sale savvy. Short Sales have become an area of special expertise just like dealing with industrial properties or ranch properties. Realtors aren’t to work outside of their area of knowledge and we believe the Short Sale has become an area that the inexperienced shouldn’t indulge without a mentor. Allow enough time, and be patient. There are significant steps to each SS transaction that you want to look for to assure progress: a. The package was received. b. The BPO was received, c. A negotiator has been assigned. d. A decision to accept or Counter is reached. Short Sales are closing much to the benefit of Buyers, Sellers and Lenders.

The latest lender technique we’ve encountered – telling us the Mortgage Insurance company requires them to get a specific minimum amount on their loan. The problem it’s a second and there is no PMI. The first won’t pay more and they will be wiped out if they don’t take the payment the first authorized. They continue to play these games to get more money.
